Public Readiness and Emergency Preparedness Act (PREP Act) 42 USC §247d-6d information applicable to Personal Protection Equipment (PPE) purchased from IFB Solutions.

The Parties acknowledge that the Public Readiness and Emergency Preparedness Act (“PREP Act”), 42 USC §247d-6d, authorizes the Secretary of the Department of Health and Human Services to issue a declaration to provide liability immunity to certain individuals and entities (“Covered Persons”) against any claim of loss caused by, arising out of, relating to, or resulting from the administration to or the use by a Covered Person of a “Covered Countermeasure” as defined in the PREP Act.  On March 10, 2020, the Secretary of HHS issued such a declaration to provide liability immunity for certain “Recommended Activities” related to Covered Countermeasures against COVID-19.  The definitions of “Covered Person,” “Covered Countermeasure,” and “Recommended Activity” were clarified further by the Coronavirus Aid, Relief, and Economic Security (“CARES”) Act and the Advisory Opinion issued by HHS on April 14, 2020.  The Parties agree that IFB Solutions is providing masks on an emergency basis to meet critical needs relating to the COVID-19 Pandemic, that IFB Solutions is a Covered Person, and that the products being qualifies as a Covered Countermeasure being provided as part of a Recommended Activity in accordance with the March 10 Declaration and the April 14 Advisory Opinion.  As such, the products being provided by IFB Solutions are covered by the PREP Act and immunity confers to IFB Solutions as a result.
